1. Operator, scope and contractual documents
These Terms govern Gina Heartwing at https://www.ginaheartwing.com, https://ginaheartwing.com and https://play.ginaheartwing.com, together with the games, stories, adventures, Heartwing Academy, Star Explorers, Heartwing Hollow, Tree House, creative tools, music and related services that expressly link to these Terms (the “Services”). The operator and contracting party for direct purchases is HEARTWING MEDIA LTD, a company registered in the Republic of Cyprus (“Heartwing”, “we”, “us” or “our”). Our company number, office address and contact particulars appear in the Legal Notice.
The Purchases and Refunds Policy forms part of these Terms for purchases. The Privacy Policy, Cookie Policy and Children and Parents Notice explain how we handle information; accepting these Terms is not consent to optional data processing. Product-specific terms shown before an order govern the particulars of that order. Mandatory law prevails over all these documents. A later policy does not retrospectively remove an accrued right or alter a completed purchase to your detriment.
2. Adults, children and acceptance
Family accounts must be opened and managed by a person who is at least 18 and legally able to contract. Children may use suitable features through an adult-managed family account or an age-appropriate guest experience. A parent or legal guardian must authorise a child’s participation and provide any parental consent required by law. An unrelated adult must not claim parental responsibility. A child’s use alone does not constitute valid adult acceptance or parental verification.
We present these Terms before family-account registration and paid orders and request affirmative acceptance. Adults should explain the relevant rules to children in language they understand and supervise their activities, spending and device use. You are responsible for activities you authorise and for taking reasonable care of account access. These Terms do not automatically make you liable for every unauthorised transaction or waive any payment, fraud or consumer protection.
3. Nature of the Services
Gina provides entertainment, imaginative play and learning activities. Available experiences, free introductory levels and paid options are identified in the relevant interface. Access to one item does not include every item, later release, expansion or Academy year unless the offer expressly says so. Free availability and prices for future orders may change. Existing paid entitlements are subject to the protections in these Terms.
Heartwing Academy and other learning activities supplement learning. They are not an accredited school, examination service, individual assessment, therapy or medical advice, and do not guarantee a particular attainment or developmental outcome. Progress indicators and Academy stars are activity feedback, not formal qualifications or a clinical assessment. Fictional characters, narrated dialogue and animated companions are not real people or a live supervision service.
4. Account security and family access
Provide accurate adult account and billing information and keep it current. Use a nickname rather than a child’s full name where possible. Keep sign-in codes or links, email access and any parent-access credentials secure; do not share them outside the authorised household. Never forward a live sign-in code or link to support. Tell support@ginaheartwing.com promptly if you suspect account misuse.
Family access is personal to the registered household and the profiles supported by the service. It does not permit account resale, rental, public account sharing, commercial group access or transfer of purchased access to unrelated people. Do not create additional accounts to evade restrictions or repeatedly obtain a one-per-family reward. We may ask for proportionate verification before changing account ownership, restoring purchases or releasing personal information. We do not require a child’s identity document merely to play.
5. Devices, connectivity and saved progress
You need a compatible device, a supported browser and, for online features, an internet connection. Relevant technical requirements and known material limitations must be disclosed before purchase. Internet and mobile-network charges are your responsibility. Browser restrictions, private browsing, blocked storage or an interrupted connection may affect saving, audio or downloads.
Guest progress may be stored only on the device. Signing out, clearing storage, changing devices or using private browsing may make local progress unavailable. Account-linked progress requires successful synchronisation. Check save confirmations before switching devices or child profiles and follow conflict-resolution messages. We take reasonable care to maintain the service, but cannot promise recovery of every unsynchronised action. This does not exclude remedies for a defect or failure for which we are legally responsible.
6. Licence and intellectual property
Subject to these Terms and the access you have obtained, we grant you a limited, non-exclusive, personal, non-transferable licence to use the Services for private, non-commercial family enjoyment. Paid access lasts for the period or scope described in the offer, subject to lawful termination. References such as “owned by your family” identify an account entitlement; they do not transfer copyright or promise indefinite operation of every feature.
We and our licensors retain our respective rights in Gina Heartwing, Heartwing Hollow, characters, names, logos, stories, artwork, music, recordings, voices, animations, software, interfaces and other protected materials. You may not extract, redistribute, sell, license or commercially exploit those materials, create unauthorised merchandise or imply our endorsement. You may not scrape protected content for model training, clone character voices or reproduce protected assets in competing products without permission, except where applicable law permits the activity. Rights in AI-assisted material are asserted only to the extent recognised by law; these Terms do not create rights that do not exist.
Restrictions do not override non-excludable exceptions, lawful interoperability rights or other mandatory rights. Commercial, school-wide, institutional, public-performance and promotional uses require a separate written licence unless the relevant resource expressly authorises them.
7. Family creations, downloads and feedback
You retain any rights you hold in original material you contribute. Our existing characters, music, artwork and other assets remain ours or our licensors’. If a feature allows saving or processing your creation, you grant us only the non-exclusive rights needed to host, reproduce, technically adapt, store and deliver it for that feature and support, including through contracted service providers. This permission does not authorise unrelated advertising use of a child’s creation or public publication without a separate lawful permission.
Downloads are permitted only through an enabled download or export function or with our permission. They remain subject to the applicable personal-use licence. You must have permission for third-party material you submit and must not include sensitive information or another person’s private details. We may use voluntarily supplied product feedback to improve the service, without treating it as permission to publish personal information. No feature should be assumed to be private merely because you have not reviewed its sharing settings.
8. Sparks, rewards and digital items
Sparks are internal virtual units used only for eligible Gina features. They are not legal tender, a bank deposit, cryptocurrency or an investment and cannot be wagered, sold, transferred between unrelated accounts or exchanged for cash. They are not a promise of a return. This restriction on cash exchange does not remove any statutory right to reimbursement of money paid.
Offers identify whether Sparks are earned, promotional or purchased and what they unlock. A reward is subject to its stated eligibility rules. Academy stars, achievements and other progress indicators are distinct from Sparks unless explicitly stated otherwise. We may correct demonstrable calculation errors, reverse fraudulent rewards or restore an incorrect deduction, with an explanation and a route to challenge the decision. We will not treat a legitimate technical complaint as fraud.
We may change future reward rates and game balance for fair play, security or improvements. We will not arbitrarily confiscate valid purchased value or retrospectively impose an undisclosed expiry on paid items. Any proposed change to existing paid access is subject to section 11 and mandatory remedies. The Purchases and Refunds Policy explains payment and withdrawal rights.
9. Acceptable use
You must not use the Services unlawfully, harass others or support staff, impersonate another person, expose a child’s personal information, infringe intellectual property, distribute malicious code, bypass payment or parent controls, exploit bugs for repeated rewards, manipulate balances or progress, use bots for abusive activity, interfere with service availability or attempt unauthorised access. Do not use the platform to collect information about children, advertise, solicit contact or arrange gambling. Reverse engineering restrictions apply only to the extent permitted by law.
If you discover a security issue, stop any unnecessary access and report it privately to legal@ginaheartwing.com with enough information to reproduce it safely. Do not access, copy or disclose other users’ information. These Terms do not prohibit protected disclosures to authorities or lawful reporting.
10. Safety and external services
Use age-appropriate activities, take breaks and use a comfortable screen brightness and sound level. An adult should supervise any suggested movement or physical activity and adapt it to the child’s abilities and surroundings. Stop an activity if it causes discomfort. The Services are not an emergency or safeguarding-reporting service.
External links, payment services and third-party platforms may have their own terms and privacy practices. A link is not an endorsement. We remain responsible for our own contractual obligations and for processors acting on our behalf as required by law. No third-party term overrides a mandatory remedy against us.
11. Updates, changes and discontinuation
We may make necessary security, compatibility and conformity updates. Beyond those updates, valid reasons for modifying an ongoing service include adapting to changed technology or legal obligations, preventing abuse, maintaining fair gameplay, addressing third-party component changes and improving functionality or accessibility. Changes will not impose additional charges on an existing contract without agreement.
We will explain material changes clearly. Where a change adversely affects access to or use of paid digital content or an ongoing digital service beyond a minor extent, we will give reasonable advance notice on a durable medium, such as email, describing the change and timing and any right to keep a conforming unchanged version or terminate without charge. Where the statutory modification right applies, termination is available within 30 days of receipt of the information or the modification, whichever is later. Applicable reimbursement rights remain available.
If we discontinue paid access, we will provide appropriate notice and the remedy required by the contract and law. A licence description does not give us an unrestricted right to remove paid content without remedy. Temporary maintenance and circumstances outside our reasonable control may interrupt service; we will take reasonable steps to reduce disruption and preserve applicable rights.
12. Suspension, termination and account closure
We may restrict access where reasonably necessary to address a material breach, fraud, account compromise, child-safety risk or legal requirement. We will use a proportionate response, give reasons and an opportunity to remedy a remediable breach where appropriate. We may act immediately where delay creates a material security or safety risk or disclosure is legally restricted.
You may ask support to review a restriction. We will consider relevant evidence and correct mistakes. Termination does not automatically forfeit every paid entitlement; refunds and other remedies depend on the reason and applicable law. You may request account closure through support or an available account control. We will explain the effect on profiles, purchases and saved work before irreversible deletion where practicable. Necessary legal records may be retained under the Privacy Policy. Exercising privacy rights is not itself misconduct.
13. Responsibility and liability
Our Services provide entertainment and general educational content. They do not provide professional advice, childcare or supervision, and we do not guarantee any particular educational, developmental or other personal outcome. Parents and guardians are responsible for choosing suitable activities, supervising children appropriately and ensuring that any activity undertaken away from the screen is safe and suitable for the child.
We are not responsible for loss or damage to the extent caused by misuse of the Services, unauthorised modifications, failure to follow reasonable safety instructions, or actions taken independently of the Services. These exclusions do not apply to the extent that our breach of contract, negligence or other legally actionable conduct caused or contributed to the loss or damage.
We do not guarantee uninterrupted or error-free access. Access may be affected by maintenance, internet connectivity, device limitations or events beyond our reasonable control. This does not affect our obligations concerning the supply, conformity, security or functionality of digital content and services, or any remedies available under applicable law.
For consumers, we exclude liability for losses that were not reasonably foreseeable when the contract was made, except where applicable law provides otherwise. The Services are supplied for private, non-commercial use. To the extent permitted by law, we are not liable for business losses, including loss of commercial profits, revenue, business opportunities or business interruption.
Where we expressly agree to supply Services to a business customer, and unless a separate written agreement provides otherwise, we exclude liability for indirect or consequential losses and for loss of profits, revenue, goodwill, anticipated savings or business opportunities. Subject to the exceptions below, our total aggregate liability to that business customer arising out of or in connection with the affected Services, whether in contract, tort including negligence, or otherwise, shall not exceed the fees paid for those Services during the 12 months immediately preceding the event giving rise to the claim. These exclusions and limitations apply only to the extent permitted by law.
Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Nothing restricts mandatory consumer rights, statutory remedies or rights under applicable data protection legislation. The business liability exclusions and cap do not apply to consumers.
14. Complaints, applicable law and courts
Contact support@ginaheartwing.com about service and purchase concerns or legal@ginaheartwing.com for legal complaints. Provide the relevant account email, order reference and a brief description, without passwords or full payment-card details. We will investigate and respond within a reasonable period; statutory deadlines remain applicable. You need not complete our complaints process before exercising a legal right or contacting an authority.
Cyprus law governs these Terms and related non-contractual obligations, without depriving consumers of mandatory protection under the law that would otherwise apply, including their country of habitual residence where applicable. Consumers retain any right to bring proceedings before their competent home courts. Cyprus courts have exclusive jurisdiction for business disputes unless mandatory law requires otherwise. These Terms impose no mandatory consumer arbitration or class-action waiver.
15. General provisions and changes to these Terms
If a provision is unenforceable, the remaining provisions continue so far as legally possible. A failure to enforce a provision immediately is not a waiver. We may transfer a contract as part of a genuine business transfer only without reducing your contractual or statutory protections, and will provide any required notice. You may not transfer your account or licence except where we expressly permit it or law requires.
We may revise these Terms for legal, security or operational reasons. We will give appropriate advance notice of material changes, explain their effect on an existing relationship and obtain fresh acceptance where required. Changes will not retrospectively alter an existing dispute. The published version and effective date identify the applicable text. These Terms do not create an employment, agency or partnership relationship.
